The Abolition of Abortion Legislative Priority

“We, the delegates of the 2016 Republican Party of Texas State Convention, call upon the 85th Texas Legislature to… Abolish abortion by enacting legislation to stop the murder of unborn children; And to ignore and refuse to enforce any and all federal statutes, regulations, executive orders, and court rulings which would deprive an unborn child of the right to life.”

 

Background

  • At the 2016 Convention, the Committee on Platform and Resolutions recommended adoption of this legislative priority with the most top votes (29 of 31) of any proposed legislative priority (it was afterwards listed as #2 because Constitutional Carry had already been a priority from the previous convention). Nearly 90% of delegates then adopted it (third highest).
  • The 85th Legislature responded to this legislative priority by filing HB 948, the Abolition of Abortion in Texas Act, which had twelve co-authors (it was ultimately denied a hearing by the chairman of the House State Affairs committee).
  • In the 2018 Republican primary, over 68% of voters supported abolishing abortion.

 

Reinforce Legislative Priorities

  • At the 2016 Convention, one of the primary rationales of the committee for re-adopting Constitutional Carry as a legislative priority was that the legislature had not yet passed it. It was reasoned then that if a legislative priority were to be adopted by the RPT, then not passed by the legislature, and afterwards removed by the RPT, it would send a signal to our Republican legislators that they could ignore the grassroots will of their party and we would go away. In other words, removing a legislative priority that has been substantially ignored would greatly weaken the entire legislative priority system.
  • Since this legislative priority was adopted, its importance has not decreased. To the contrary, an estimated 110,000 Texas babies have been aborted since then.

 

End 45 Years of Failure

  • Since 1973, the primary strategy to end the evil of abortion has been to elect pro-life presidents to appoint pro-life Supreme Court justices to overturn Roe. However, this strategy has not worked.
  • History indicates that even Republican-appointed justices are more likely than not to uphold Roe. In fact, five of the justices who decided in favor of Roe were Republican-appointed, including the author of the Roe opinion. Since Roe, the Court has remained majority Republican-appointed (except for a brief tie after the death of Justice Scalia), and every single chief justice has been Republican-appointed, yet Roe has not been overturned.

 

Follow the Constitution

  • Nothing in the U.S. Constitution protects a right to an abortion. Moreover, the idea of a federal judicial opinion compelling states to allow the slaughter of innocent babies runs completely contrary to the text and principles of the Constitution. Roe is not only unconstitutional, it is anti- constitutional. More than that, it is evil.
  • The Supreme Court’s power is not unlimited; and if the power to sanction the murder of 60,000,000 babies over the last 45 years is not beyond the limit of its power, what is? Do we not have a line which, if crossed, we would say no? If not for the sake of these innocent image-bearers of God being slain by the tens of millions, then what?
  • We must draw a line in the sand by re-adopting this legislative priority.

If a law pursuant to this legislative priority were enacted, wouldn’t it cause chaos?

What if the federal government cuts our funding or sends in agents to enforce Roe?

The people of Texas murder 60,000 babies every year while the prolife politicians we’ve elected to protect them attempt to regulate the practice of child sacrifice as if it were healthcare instead of addressing it as murder. The governing authorities of our state possess the moral, legal, and constitutional duty to establish justice for all human beings within their jurisdiction, including the preborn fatherless by prohibiting the slaughter of children in the womb. Contrary to widespread misinformation, the right to murder humans is not protected by the Constitution and our legislature is not bound by any law or duty to aid or abet the Supreme Court in their attempted perversion of it. On the contrary, they are duty bound by their oaths to support, obey, and defend the United States Constitution and oppose such perversions and abuses of it. We demand that our legislators stop passing laws to regulate abortion. We demand the total and immediate abolition of human abortion.

Next week, Republicans from all over Texas will gather in San Antonio for the 2018 Republican Party of Texas state convention. State delegates will debate and decide what conservative positions the RPT should ascribe to and what legislation Republican legislators should support. AATX will be there to advocate the complete abolition of abortion in our state and recruit other like-minded Republicans to this work.

In light of the many conservative issues of our time, we believe this issue is of utmost importance. Since the last state convention alone, an estimated 110,000 babies have been murdered in Texas. If there were ever a time for Texas Republicans to break away from the unsuccessful status quo of the past and stop merely regulating abortion, now is the time.
